of Service
We are glad that you are interested in Spark Plugin! By using Spark Plugin you agree to be legally bound by these Terms and all terms, policies and guidelines incorporated by reference in these Terms. If you do not agree with these Terms in their entirety, please restrain from using Spark Plugin.
Definitions
Spark Plugin is a Squarespace plugin that improves websites with beautiful presets for buttons, backgrounds, links, images, headings, and more.
“Spark Plugin” refer to our web plugin, websites, dashboard, and content.
“You” or “Your” refer to the person or entity that’s registered with us and uses Spark Plugin.
“Terms” refers to out Terms of Service, which includes our Privacy Policy.
General rules
To use Spark Plugin, you must (a) complete the registration process; (b) provide current and accurate information; (c) agree to these Terms; and (d) promise to abide by the conditions below:
You are responsible for all content you provide and your activities on Spark Plugin;
You will use Spark Plugin in compliance with all applicable laws, rules, and regulations;
You understand that Spark Plugin uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run Spark Plugin;
You must not modify, adapt or hack Spark Plugin;
You are a human. Contact Spark Plugin if you want to use it with a bot or automation;
Your login may only be used by people on one organisation – a single login shared by people from multiple organisations, companies, etc., is not permitted.
Intellectual property
You own your content. We do not represent any ownership or claim any intellectual property rights over the information that you provide or that is provided to us. We own Spark Plugin and you may not copy, reproduce, alter, modify, resell, mirror, or create derivative works of Spark Plugin without our written permission. Any suggestions, enhancement requests, recommendations or other feedback we receive from your or your agents is subject to a royalty-free, worldwide, transferable, sub-licensable, irrevocable and perpetual license, granted to us, to incorporate into Spark Plugin for improvement.
Passwords and accounts
You’re responsible for keeping your account name and password confidential. You agree to notify us immediately of any unauthorized use of your account(s). We’re not responsible for any losses due to stolen or hacked passwords. However, we do our best to keep your information private.
Affiliates
Not allowed:
Self-referrals are not allowed (i.e. signing up for Spark Plugin through your own affiliate link)
Promotion through coupon sites, apps, and similar, are not allowed.
Abuse, gaming, or attempting to mislead will result in your account being permanently banned.
No ads that link to our website or anything similar that would compete with our own paid marketing and drive up our costs and potentially cause confusion.
No pretending to be acting on behalf of us (ie. as an employee).
We reserve the right to terminate your affiliate account for violation of any of the rules at our sole discretion. Commissions generated by mechanisms that are in violation of our Terms of Service will not be paid or owed.
Commissions are paid:
Every other month, or earlier
Via PayPal. In order to receive payment, you must provide a valid PayPal email address.
Payouts are always made, no payout limit
Designer plan
When a Designer plan has been subscribed to for at least 12 months, the “changes stay forever”-feature become active. This means that any changes made with Spark Plugin on websites will stay active, even when the Designer plan is cancelled. Changes will stay active for as long as Spark Plugin is in business. Even if we can’t guarantee that Spark Plugin will be active for all eternity, we will stay committed to do our best of making Designer plans be active for a long time.
Payment terms
Spark Plugin is billed in advance on a yearly or monthly basis, depending on your plan. No refunds for partial use or the amount of time left in your subscription are offered unless otherwise explicitly agreed. Your account will automatically renew unless you change your subscription. You shall ensure that sufficient funds are available on the relevant account and acknowledges that late payment may result in a cancellation of Spark Plugin. All fees are exclusive of all taxes or duties imposed by governing authorities. You are solely responsible for the payment of all such taxes or duties.
Cancellation and termination
You alone are responsible for the proper cancellation of your account. You may cancel your account at any time in Spark Plugin. Cancel your account on the dashboard or contact us. Violation of any part of the Terms of service may result in the termination of your account. We also reserve the right to refuse service to anyone and close your account without notice for any or no specific reason.
Representations and warranties
To the maximum extent permitted by law, we provide Spark Plugin on an “as is” and “as available” basis, which means we don’t provide warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability and fitness for a particular purpose and to any warranties that:
- Spark Plugin will meet your specific requirements or expectations;
- Spark Plugin will be uninterrupted, timely, secure, or error-free;
- Any errors in Spark Plugin will be corrected.
Limitation of liability
To the fullest extent permitted by law, you assume full responsibility for and we disclaim liability to you for any indirect, consequential, exemplary, incidental, or punitive damages, including lost profits, even if we had been advised of the possibility of such damages. We disclaim any and all liability for the acts, omissions, and conduct of any third parties related to your use of Spark Plugin and any linked sites and services. Your sole course of action against us regarding service dissatisfaction with Spark Plugin is to stop using Spark Plugin. This limitation of damages is a central part of our agreement. The preceding disclaimer applies to any damages, liability, or injuries whether for breach of contract, tort, negligence or any other course of action. If, notwithstanding the other provisions of the Terms, we are found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of Spark Plugin, our liability shall not exceed what you paid us for Spark Plugin.
Amendments and changes
We reserve the right, at our sole discretion, to change, modify, add, or remove portions of the Terms, at any time with or without a notice. Amendments or changes to these Terms will come into effect as soon as we post the revised Terms. It is your responsibility to check the Terms periodically for changes. Your continued use of Spark Plugin following the posting of changes will mean that you accept and agree to the changes. We reserve the right to do any of the following, at any time, without notice to you: (1) to modify, suspend or terminate operation of or access to Spark Plugin, or any portion of Spark Plugin for any reason; (2) to modify or change Spark Plugin, or any portion of Spark Plugin, and any applicable policies or terms; and (3) to interrupt the operation of Spark Plugin, or any portion of Spark Plugin, as necessary to perform routine or non-routine maintenance, error correction, or other changes.
Force majeure
You agree that we are not liable for any delays or failure in performance of any part of the Services, from any cause beyond our control.
Assignments
You may not assign any of your rights under this agreement to anyone else. We may assign our rights to any other individual or entity at our discretion.
